The legal system of the Republic of Serbia does not contain rules that specifically regulate the protection of the family home. This work, along with the analysis of comparative legal systems, checks whether it would be desirable to include provisions related to the special protection of the family home in the domestic legislation, or whether the existing provisions are sufficient for this legal institution to enjoy essential protection in our country. Special attention is paid to solutions from French legislation, where the protection of this legal institution is highly developed.
The main reason for determining the topic of the work was the fact that the protection of the family home was introduced into the family legislation of the Republic of Srpska in 2023, as a special institution of family law, which made the Republic of Srpska a pioneer in the region in terms of providing for the special protection of the family home.
