Abstract:
Real servitude seems to be an unjustifiably neglected topic in theoretical works of our lawyers. Many people consider them too „rural“ and of almost no practical interest nowadays. On the other hand, the institute of prescription slowly goes to history, as a category that loses its importance (but, in our opinion, only in the field of real estate ownership). For these reasons the author was inspired to connect the abovementioned institutes in one topic and try to show that prescription, as a way of acquiring real servitude, has a significant field of application.
Keywords:
real servitude (easements), prescription, bona fides, correctness and legality of possession.
